These general conditions of sale (hereinafter the “CGV”) govern all relations between www.infestations.fr managed by the company SWAP, SASU with share capital of €1,000, SIREN: 895077691, whose head office is located at 43 rue Aviateur le brix, 13009 Marseille, France and t any buyer (hereinafter the “Customer(s)”) making a purchase via the website (hereinafter the “Site”) of the Company.

The SWAP Company carries out a retail activity of mosaic kits to make yourself.

By placing an order on the Site, the Customer declares that they are purchasing the Products for strictly personal purposes and not directly related to a professional activity. He thus acts for purposes which do not fall within the scope of his commercial, industrial, artisanal or liberal activity.

All orders placed on the site are subject to these general conditions of sale.

Prior to any transaction, the customer acknowledges having read these general conditions and expressly declares to accept them when he clicks on the “Validate payment” button.

The SWAP Company reserves the right to adapt or modify these General Terms and Conditions at any time, the version of the general conditions of sale applicable to any transaction being that appearing online on the site www.infestations.fr at the time of the order.

ARTICLE 1 - THE CUSTOMER

The Customer declares to be a natural person, aged at least 18 years old and to have the legal capacity or to hold parental authorization allowing them to place an order on the site. When recording the Customer's personal data when ordering, the latter must ensure the accuracy and completeness of the data necessary for the performance of the service it provides. In the event of an error in the wording of the recipient's contact details, the Company SWAP cannot be held responsible for the impossibility of delivering the product.

The society SWAP reserves the right to cancel any order when the customer's IP address is domiciled in a country different from the billing and/or delivery address.

ARTICLE 2 - PRODUCTS

The products offered for sale are those described on the Site. Products offered by the Company SWAP complies with the standards applicable in France.
The society SWAP takes the greatest care in the presentation and description of these products to best inform the Customer. However, it is possible that non-substantial errors may appear on the Site, which the customer acknowledges and accepts. In any event, in the event of non-compliance of the product delivered with its description on the Site, the Customer may either exercise his right of withdrawal or implement the Company's guarantee of conformity. ARTICLE 3 - THE ORDER

Taking orders on the Site is subject to compliance with the procedure put in place by the Company. SWAP materialized by a succession of different steps that the customer must follow to validate their order. The customer will have the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all general conditions of sale.

If, despite the vigilance of the Company SWAP , the products are unavailable, the Company SWAP will inform the Customer by e-mail as soon as possible. The Customer may then cancel his order and be reimbursed, if applicable, for sums already paid.
Permanent or temporary unavailability cannot in any way engage the liability of the Company. SWAP , nor can it give rise to any right to compensation or damages in favor of the Client.

A confirmation email summarizing the order (products, prices, product availability, quantity, etc.) will be sent to the customer by the Company. SWAP .

ARTICLE 4 - PRICES AND PAYMENT TERMS

1. PRICE DETERMINATION

The prices of the products are indicated in euros, all French taxes included, excluding shipping costs. The total price of the order (including all taxes and shipping costs) is indicated in the basket.

The society SWAP reserves the right to modify its prices at any time, without notice and in particular in the event of a change in tax or economic data, but the products will be invoiced on the basis of the prices in force at the time of registration of the order, under availability reserve.

2. PAYMENT TERMS

The products are payable in full in cash on the day of the actual order.

Payment for purchases is made by credit card on a secure server via the Shopify Payment application (Mastercard, Visa, CB, ApplePay) or via the Paypal platform.

Under no circumstances will the company SWAP does not have access to the customer's bank details.

In this regard, the Customer expressly acknowledges that the communication of his bank card number to the Company SWAP constitutes authorization to debit your account up to the products ordered.

3. DATA

Data recorded and kept by the Company SWAP constitutes proof of the order and all past transactions. The data recorded by the payment system constitutes proof of financial transactions.

ARTICLE 5 - DELIVERY

SWAP delivers its products to France, Andorra, Monaco, England and the European Union.

Delivery is made to the delivery address indicated by the customer, it being specified that this must be the residential address of the customer or any other natural person of their choice.

The deadlines indicated are indicative deadlines, corresponding to the average processing and delivery times. The society SWAP cannot be held responsible for the consequences due to a delivery delay not of its fault.

The customer must ensure that he has communicated accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or numbers). intercom, etc.).

In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and the Company SWAP , by any means, all reservations within 3 days following receipt of the product.

The society SWAP cannot be held responsible for the consequences due to a delivery delay not of its fault.

ARTICLE 6 - RETURNS

The customer has 14 days to return their package. Return costs are the responsibility of the customer.

For any refund request, see Article 8.

ARTICLE 7 - RIGHT OF WITHDRAWAL

The individual Customer has a right of withdrawal, which he can exercise without reason, within fourteen (14) clear days from delivery of the order which will be exercised by returning new products at his own expense. (in their original packaging) accompanied by the order number to the following address:

The society SWAP will reimburse the Customer for any sums already paid, less any shipping costs, under the conditions referred to in Article 8.

ARTICLE 8 - REFUND

Reimbursements of products in the cases referred to in Article 2 and Article 7 will be made by the Company. SWAP within a maximum period of 30 days after receipt by it of said products. Reimbursement will be made according to the payment method chosen by the customer at the time of their order or by issuing a voucher.

When delivered by Mondial Relay, the package is available for up to 8 days at the relay point chosen by the customer. Once the deadline has passed, the package is returned to our workshop. Therefore, if the package is not collected, you can ask us for a partial refund of the order by simple written request. Delivery costs are not refunded. Service and payment fees are also not refunded.

ARTICLE 9 - CUSTOMER DATA - GDPR

Users and customers have the right to rectify their personal data at any time and upon simple request to the address contact@invasions.fr .

When you subscribe to our newsletter, or place an order by accepting the use of your personal data (SMS, email), SWAP may use this data for promotional purposes.

Never, SWAP will not communicate this data to a third party for promotional purposes. This data may be communicated to logistics partners for order tracking purposes only.

ARTICLE 10 - APPLICABLE LAW

Any order automatically entails the customer's acceptance of the general conditions of sale.

These general conditions of sale are governed by French law. In the event of a dispute, the French Courts will have sole jurisdiction. In the event of a difficulty or complaint regarding an order, the customer can contact Customer Service to find an amicable solution by sending an e-mail to contact@invasions.fr .
